律师参与社区矫正工作机制探究

On Working Mechanism of Lawyer's participation in Communicity Correction

《中华人民共和国社区矫正法》的颁布标志着中国社区矫正工作步入法治化、高质量发展的新阶段,国家鼓励和动员社会力量参与社区矫正,但从法律规定和实务情况看,律师参与较为薄弱甚至缺漏是一个比较突出的问题。社区矫正与律师职责具有较高的契合度,律师参与社区矫正工作具有必要性和独有的优势。应当通过健全社区矫正制度,鼓励和引导律师尤其是刑事律师参与社区矫正,充分发挥律师在社区矫正中的重要作用,促使社区矫正对象顺利回归社会。

The Community Correction Law signals the new stage of community correction with its legalization and high-quality development in China.The state encourages and mobilizes social energy to participate in the community correction,but the lawyer's participation is still weak.Lawyers,especially criminal lawyers,should be encouraged to participate in the community correction issues to play their effective role with their duty's accordance with community correction so as to realize the smooth return of community correction objectives to the society.
