党的十八大以来我国惩治腐败犯罪检视:成就、问题及前瞻

On the Punishment of Corruption in China Since the 18th National Congress of CPC:Achievements,Problems and Prospects

党的十八大以来,一大批腐败犯罪分子,特别是省部级高官的查处创历史新高,一个统一、高效、权威的反腐败机构已组建完成,腐败犯罪立法获得重大进展,反腐败国际追逃取得重大突破。存在的主要问题是:治本力度不够,权力过于集中,制约监督机制缺失;刑事追究比例低,刑事处罚力度大幅度下降;如何加强对国家监委的监督成为新的难题;腐败犯罪立法不完善。未来我国腐败犯罪治理,要加大治本力度,从源头上治理腐败犯罪;保持反腐高压态势,查办腐败犯罪不松懈;加强对监委的监督制约,着力解决“监督者如何受监督”的难题;进一步完善腐败犯罪立法,降低腐败犯罪构成条件。

Since the 18th National Congress of the Communist Party of China,a large number of corrupt criminals,especially senior officials at the provincial and ministerial levels,have been investigated and dealt with at a high record.A unified,efficient and authoritative anti-corruption agency has been established.Significant progress has been made in the legislation of corruption crimes,and major breakthroughs have been made in the international pursuit of corruption.The main problems are:inadequate governance,over-centralized power,lack of supervision mechanism;low rate of criminal investigation,sharp decline in criminal punishment;how to strengthen the supervision of the National Supervision Commission has become a new problem;corruption crime legislation is not perfect.In the future,the governance of corruption crime in China should strengthen the efforts to cure the root cause and control the corruption crime from the source;keep the anti-corruption high-pressure situation,and do not slacken the investigation of corruption crime;strengthen the supervision and restriction of the supervision committee,and strive to solve the problem of“how to supervise the supervisors”;further improve the legislation of corruption crime and reduce the constituent conditions of corruption crime.
