《海牙判决公约》中知识产权条款研究——兼论我国知识产权判决的跨国承认与执行的完善

A Study on the Intellectual Property Provisions in the“Hague Convention on Judgment”——On the Improvement of Transnational Recognition and Enforcement of Intellectual Property Judgments in China

传统的普通涉外民事诉讼程序规定已经不能满足新型背景下对知识产权在程序法上的保护,知识产权领域亟待国际利用与合作。现行关于知识产权的国际公约或判决的承认与执行的公约都未明确知识产权判决的承认与执行。海牙国际私法会议“判决项目”是针对法院的国际管辖权以及判决的承认和执行两个方面展开的工作,《海牙判决公约》谈判过程中就知识产权问题展开了激烈的讨论,公约谈判中关于知识产权作为公约排除事项、专属管辖权、先决问题、救济措施等的规定对我国具有很大的影响。“判决项目”外交大会的举行标志着《海牙判决公约》谈判的最终完成,对公约中有关知识产权的内容进行整体考量,对于完善我国知识产权跨国判决承认与执行具有重要意义。

Since traditional rules of ordinary civil procedures concerning foreign affairs fail to satisfy the protection of intellectual property in procedural law under present context,international cooperation is urgently required.None of the existing international conventions on the recognition or enforcement of intellectual property rights or judgments has clearly defined the recognition and enforcement of intellectual property rights judgments.The Hague Conference on Private International Law’s“Judgment Project”is aimed at the court’s international jurisdiction and the recognition and enforcement of judgments.During the negotiation process of Convention on Judgment,heated discussions on intellectual property issues occurred.Staff like property rights as provisions of the Convention’s exclusions,exclusive jurisdiction,prior issues and remedies have a great impact on our country.The“Judgment Project”Diplomatic Conference marked the final completion of the“Hague Convention on Judgment”negotiations.The overall consideration of the intellectual property content of the Convention is of great significance for improving the recognition and enforcement of intellectual property transnational judgments.
