摘要
短视频法律性质似乎已经等同作品,这需要重新进行审视。未分类讨论、版权保护意识及政策增强产生研究方向的导向性,容易将短视频直接与版权相连接,加上独创性标准本身就有认定不清等适用问题,出现了作品认定热潮现象。以社交类短视频为例,从版权框架角度,综合考虑各标准避免过于放大等极端问题;还要考虑限制因素,即最小尺寸原则及利益平衡理论,会得到与现今完全不同的结论。对不能受作品保护的,可以通过重新构建为作品以及反不正当竞争的途径进行保护。
The legal nature of short videos seems to be considered the same as works themselves,which needs to be reexamined.Issues like lack of classification and discussions,copyright protection awareness and policy enhancement lead to certain research orientation,and it is easy to connect short videos with copyright directly.In addition,the criteria for ingenuity can hardly be clearly identified,which triggers identification upsurge of works.Social short videos as an example,from the perspective of copyright’s framework,all criteria should be comprehensively considered to avoid being manifested.In addition,we also need to consider the limitations of the recognition of works,such as the minimum size principle and the balance of interests theory,which may lead to a completely different theory.Short social videos that cannot be protected by copyrights can be protected by rebuilding and anti-unfair competition.
