司法责任制改革背景下检察权监督制约机制研究

Research on Supervision and Control Mechanism of Procuratorial Powers in the Context of Judicial Responsibility System Reform

检察权作为一项重要的国家权力,兼具行政与司法属性。在司法责任制改革过程中,"谁办案谁负责,谁决定谁负责",成为检察权运行的重要原则,进而对检察权的监督和制约提出了更高的要求。在司法实践中,对检察权的内外部监督制约仍存在一定的漏洞和不足,为进一步发挥好检察权的有效作用,构建出具有体系化的内外部监督制约机制是当前司法体制改革的重要内容。

The procuratorial power,as an important state power, has both administrative and judicial attributes. In the process of judicial responsibility system reform,"who is responsible for handling the case and who makes a decision is responsible for it"has become an important principle of procuratorial power operation,and then higher requirements for the supervision and restriction of procuratorial power is put forward. In judicial practice,there are still some loopholes and shortcomings in the internal and external supervision and restriction of procuratorial power.In order to further play the effective role of procuratorial power,it is an important content of the current judicial system reform to construct a systematic internal and external supervision and restriction mechanism.
