中韩法律文本翻译的消极修辞法探究

A Study on the Chinese Translation of ROK's Laws from the Perspective of Negative Rhetoric

消极修辞法的目标是让语言表达准确、严谨和周密,这与法律翻译的目标基本是一致的。本文以韩国法制处对韩国法律的汉译为例,从消极修辞的角度探讨了如何提升韩国法律汉译质量问题,提出在词语方面应使用语义确切单一、色彩中性、音韵自然的词语,在句子方面应使用常式句、长句、紧句等句式,在语篇方面应保留以条为单位的法条文结构、准确使用相关关联词、注意法律用语统一等。

The goal of negative rhetoric is to make language expression accurate,which is basically consistent with the goal of legal translation.Taking the Chinese translation of ROK's laws of Ministry of Government Legislation of ROK as an example,this paper probes into improving the accuracy of the translated language expression from the perspective of negative rhetoric.The methods to improve the accuracy of translation include using accurate and single words,using dispassionate and natural words and using regular,long and compact sentences as much as possible.In the aspect of discourse,it should keep the text structure as a unit,using the relevant words accurately,and paying attention to the unity of the legal terms.
