再交涉制度对建设工程施工合同适用情势变更原则的影响分析

Research on the Effect of Renegotiation System on Situation Alteration Principle in Construction Project Contract

通过对既有情势变更的审判案例及法院最终审判意见进行分析,找出现行情势变更原则在建设合同纠纷判定中的限制与不足,并对《合同编》中引入的再交涉制度在建设合同发生纠纷时发挥的效率价值进行分析。最终得出结论:在建设工程施工合同的履行中,引入再交涉制度对情势变更纠纷进行处理,能够有效缓解法官基于个人对法律认知不同导致法律适用时的不确定性,对保护建设合同双方意思自治、实现法的效率价值、促进合同顺畅进行具有现实意义。

The paper finds out the limitation and deficiency of the current principle of change of circumstances in dispute determination by the analysis of the trial cases of the change of circumstances and the final judgment of the court,in addition,makes analysis of the efficiency value of the renegotiation system introduced in the“Contractual Arrangements”when it occurs disputes for construction contract.Finally,During the implementation of construction project contract,it is possible to alleviate judge’s uncertainty when applying the law based on different personal legal cognition,if the renegotiation system is introduced to deal with disputes related to changed circumstances.This is of great significance to protect autonomy of both parties’will in construction project contract,realize the efficiency value of law,and smooth the contract implementation.
