环境犯罪视角下附条件不起诉制度的扩展适用

环境犯罪的刑罚处罚具有打击环境犯罪、保护生态环境的积极一面,但也存在社会认同度低、不能完全实现刑罚处罚功能、不符合环境犯罪刑法治理的经济性要求等弊端。附条件不起诉制度作为治理轻微刑事犯罪的一项重要制度,在环境犯罪领域的修复受损生态、实现诉讼经济等方面也具有明显的功能优势,将其扩展适用于环境犯罪领域,符合恢复性司法、诉讼经济和当事人化的价值目标。就具体适用规则而言,在主体方面,适用于犯罪情节轻微,自愿修复环境的自然人或单位;在适用条件方面,附条件不起诉的先决条件是自然人或单位曾有良好的环境保护记录,悔过态度良好,愿意承担环境修复的责任;在适用程序方面,要严格依照法律法规,并自觉受公众监督。

The penalties for environmental crimes have the positive side of combating environmental crimes and protecting the ecological environment,but there are also drawbacks such as low social acceptance,the inability to fully realize the function of penalties,and the failure to meet the economic requirements of the criminal law of environmental crimes.The conditional non-prosecution system,as an important system for the treatment of minor criminal offence,also has obvious functional advantages in the field of environmental crimes,such as the repair of damaged ecology,litigation economy,etc.,and its extension to the field of environmental crimes is consistent with the value objectives of restorative justice,litigation economy and should be a litigant.In terms of the specific application of the rules,in terms of the subject,it applies to natural persons or units who have committed minor crimes and voluntarily repair the environment;in terms of the conditions of application,the precondition for not prosecuting is that the natural person or unit has a good record of environmental protection,has a good attitude of repentance and is willing to assume responsibility for environmental repair;in terms of the application of the procedure,it should be strictly in accordance with laws and regulations and consciously subject to public supervision.
