我国专利确权程序改革研究

Research on the Reform of Patent Confirmation Procedure in China

专利无效宣告程序之定性与专利确权单轨制模式之变更一直是我国专利确权程序改革的两大基本问题,然而最新修改并公布的《专利法》(2020)并未对此作出准确回应,也未能针对目前由于上述两个基本问题的模糊所带来的不良影响而提出相应改革,进而为优化我国专利确权程序与效率,必须深度解析以上两大问题之内在机理,并予以正面回答。传统专利确权程序往往局限于专利权的私权属性,而对其特殊性即与公共利益的密切联系,以及专业技术性较强这两个特殊性未能全面反映。通过法理分析与比较研究得出,我国专利无效宣告制度也应定性为行政属性。此外,建议我国将北京知识产权法院作为专门审判专利权有效性的审判机构,探索行政与司法共同审查专利权有效性的可行性路径。

The nature of patent invalidation declaration procedure and the modification of the monorail system of pat⁃ent right verification have been two basic problems in the reform of the patent right confirmation procedure in China.However,the latest revised and published Patent Law(2020)does not give an accurate response to this,nor has it pro⁃posed corresponding reform to address the adverse effects caused by the ambiguity of the above two basic issues.In or⁃der to optimize the procedure and efficiency of patent confirmation in China,we must deeply analyze the internal mech⁃anism of the above two questions and give a positive answer.The traditional patent right confirmation procedure is usu⁃ally limited to the private property of patent right,and fails to fully reflect its particularity,that is,its close connection with the public interest,and its strong specialty and technicality.Through jurisprudence analysis and comparative study,it is concluded that China's patent invalidation system should also be characterized as an administrative attri⁃bute.In addition,it is recommended that the Beijing Intellectual Property Court can be designated as a specialized tri⁃al agency for trials of the validity of patent rights,and the feasibility path of administrative and judicial joint examina⁃tion of the validity of patent right is explored.
