摘要
宪法文本规定引发了关于检察权性质的分歧,对检察权性质的规范解读需要以宪法及宪法性文件的沿革演变为依据。检察院是国家的法律监督机关,其行使的检察权并非是简单的行政权或监督权,而应当被界定为一种司法监督权,包含侦查权能、诉讼权能和监督权能三个维度。监察制度改革对检察权的监督权能提出了更高要求,公益诉讼和检察建议应当成为检察机关诉讼权能和监督权能新的探索和发展方向。
Constitutional textual provisions have led to differences on the nature of procuratorial power,the normative interpretation of the nature of prosecutorial power needs to be based on the evolution of the Constitution and constitutional documents.The procuratorate is the state's legal supervisory organ,and its exercise of procuratorial power is not simply administrative or supervisory,but should be defined as a judicial supervisory power,including the three dimensions of investigative,litigation and supervisory powers.The reform of the supervisory system of the procuratorial power puts forward higher requirements,public interest litigation and procuratorial recommendations should become the new exploration and development direction of the procuratorial litigation power and supervisory power.
