论涉枪案件量刑的科学化

On the Scientific Sentencing of Gun-related Cases

近年来,刘大蔚、赵春华等涉枪案,充分暴露出我国司法实践中法院对涉枪案件的量刑存在严重缺陷。为实现涉枪案件量刑的科学化,在刑事政策方面,有必要对“整体从严”的政策予以调整,逐步建立“轻轻重重”的涉枪案件刑事政策;在刑事立法及司法解释的规范化方面,必须摒弃粗放化、简单化的顽疾,实现刑事立法及司法解释的精细化;在定罪量刑标准方面,必须摒弃重客观要素特别是唯数量论的倾向,实现对客观要素和主观要素的等量齐观。

In recent years,the gun-related cases of Liu Dawei,Zhao Chunhua and the like have fully exposed the serious defects in the sentencing of gun-related cases by the courts in China’s judicial practice.In order to realize the scientific sentencing of gun-related cases,it is necessary to adjust the"overall strict"policy in terms of criminal policies,and gradually establish a"Combining punishment with the Crime"criminal policy for gun-related cases;in terms of the standardization of criminal legislation and judicial interpretation,it is necessary to abandon the persistent problems of extensiveness and simplification,and realize the refinement of criminal legislation and judicial interpretation;besides,in terms of conviction and sentencing standards,it is necessary to abandon the tendency of emphasizing objective factors,especially quantity theory,so as to realize the equal view of objective factors and subjective factors.
