基于实证的侦查讯问中言语问答策略研究

侦查讯问是刑事诉讼的关键环节,也是一门艺术性较强的综合科学,讯问中的发问与应答,是侦查人员与犯罪嫌疑人进行沟通交流的主要媒介,是讯问方法与策略的直接体现。新时期犯罪行为日趋呈现职业化、智能化与团伙化特点,犯罪嫌疑人高对抗性尤为突出。基于侦查讯问笔录实例分析,深入研究当前侦讯语言运用中存在的问题,从侦讯理念的转变、言语问答方式方法的灵活运用、侦问工作智力保障等多方面,进一步挖掘侦讯言语问答策略提升路径,对于侦查讯问工作的持续改革与创新,具有重要的现实意义。

Investigation and interrogation is a key link in criminal proceedings,and it is also a highly artistic comprehensive science.Questions and responses in interrogation are the main medium for communication between investigators and criminal suspects,and they are the direct embodiment of interrogation methods and strategies.In the new era,criminal behavior is becoming more and more professional,intelligent and gang oriented,especially the high antagonism of criminal suspects.Based on the case analysis of investigation and interrogation records,this paper deeply studies the problems existing in the use of Interrogation Language,and further explores the improvement path of interrogation verbal questioning strategy from the aspects of the transformation of investigation idea,the flexible use of speech question and answer methods,and the intelligence guarantee of investigation and interrogation work,which is of practical significance for the continuous reform and innovation of investigation and interrogation work.
