探明矛盾产生的深层根源,是推进制度变革、妥善解决纠纷的重要前提。医疗纠纷问题,是新世纪中国社会遭遇的一个棘手问题,也是现代各国的共同难题之一。医疗纠纷的泛滥,直接源于学界强调的医院内部管理不科学、医卫制度不完善、医疗纠纷解决机制存在缺陷等直观原因,但其深层根源却主要在于现代社会医病关系的陌生人化、科学理性与常识理性的隔膜化、医疗服务市场中的资本逐利本性,以及“法不懂医”的医疗纠纷解决困境。因此,现代医疗纠纷的根本解决,亟需从顶层设计出发,构建系统协作的科学治理模式与具体规制体系。

To explore the deep-rooted causes of contradictions is an important prerequisite for promoting institutional changes and properly resolving disputes.The issue of medical disputes is a thorny issue not only for China but also for almost every modern country.The spread of medical disputes is due to the intuitive reasons that the hospital administration is not scientific,the medical system is imperfect,and the medical dispute resolutions is flawed.However,its deep roots stem from the strangerization of doctor-patient relations in modern society,the separation of scientific rationality and common sense,the failure of medical market regulation,and the dilemma of“judges can not understand medicals”.Therefore,its fundamental solution calls for the construction of scientific structure and specific regulations under a correct top-level design.
