雄安新区立法权限配置研究

Research on the Allocation of Legislative Authority in Xiong'an New Area

雄安新区建设应当坚持立法先行,保障各项政策和改革措施于法有据。目前雄安新区立法权限配置尚不明确,立法权限的配置受到自然环境因素、经济发展因素以及政策环境因素的影响。授权立法下雄安新区存在暂时调整适用有关法律规定、全国人大授权立法和河北省人大及其常委会授权立法三种配置途径;职权立法下雄安新区可过渡到城市管理体制建设成设区市,依法享有制定地方性法规和地方政府规章的立法权限。

In the construction of Xiong'an New Area,we should insist on legislation first and ensure that all policies and reform measures are based on law.At present,the allocation of legislative authority in Xiong'an New Area is not clear.The allocation of legislative authority is affected by natural environment factors,economic development factors and policy environment factors.Under the authorized legislation,Xiong'an New Area has three allocation ways:temporary adjustment and application of relevant laws and regulations,the authorized legislation of the National People's Congress and the authorized legislation of Hebei Provincial People's Congress and its Standing Committee;under the authority legislation,Xiong'an New Area can transition to the construction of urban management system into a city divided into districts and cities,and enjoy the legislative authority to formulate local laws and regulations and local government rules.
