摘要
新浪网诉天盈九州案、央视网诉聚力传媒案的审理期间,正处在著作权法第三次修订过程中,案件审理引发了司法界和实务界关于体育赛事画面是属于“作品”“电影作品”还是“类电影作品”的争议。导致争论的原因,一个是法律上的,一个是技术上的,法律与技术的互动在从“电影作品”到“视听作品”的变化中发挥了重要的作用。因应技术发展而采用的“视听作品”概念,极大降低“电影作品”概念下连续影音画面构成作品的门槛,有助于解决包括体育赛事画面在内的新型影音制品的属性问题。
During the trial of Sina.com v.Tianying Kyushu and CCTV.nv v.Juli Media,the copyright law is in the third revision process.The trial of the case has triggered a dispute between the judicial and practical circles about whether the pictures of sports events belong to"works","film works"or"film-like works".The reasons for the debate are legal and technical,and the interaction between law and technology has played an important role in the change from"film works"to"audio-visual works".The concept of"audiovisual works"adopted in response to technological development has greatly lowered the threshold for continuous audio-visual images to constitute works under the concept of"movie works",which is helpful to solve the attribute problem of new audio-visual products,including pictures of sports events.
