政府信息公开背景下国家秘密保护制度的完善

Improvement of State Secrets Protection System Under the Background of Government Information Disclosure

自《政府信息公开条例》公布以来,政府信息公开工作与国家秘密保护工作产生了一些冲突。《中华人民共和国保守国家秘密法》等涉及保密制度的法律法规,在一些方面限制了政府的信息公开。新《政府信息公开条例》的公布,在某种程度上加剧了信息公开和国家秘密保护工作失衡的局面。协调处理政府信息公开与国家秘密保护的矛盾,需要从制定统一的《政府信息公开法》和完善《保守国家秘密法》等保密法律相关规定两个方面着手,在保证政府信息公开透明的基础上健全国家秘密保护制度,进一步保障公民的知情权。

Since"Government Information Disclosure Regulation"was published,there have been some conflicts between the disclosure of government information and the protection of state secrets.The laws and regulations concerning the secrecy system,such as"Law of the People’s Republic of China on Guarding State Secrets",restrict the disclosure of government information in some ways.The enactment of the newly revised"Government Information Disclosure Regulation"has exacerbated the unbalanced situation of information disclosure and state secrets protection.In order to coordinate and handle the contradiction between the disclosure of government information and the protection of state secrets,it is necessary to improve the state secrets protection system to further protect citizens’right to know with the formulation of a unified"Government Information Disclosure Law"and the improvement of the"Law of the People’s Republic of China on Guarding State Secrets"and other relevant provisions of secrecy laws on the basis of ensuring the transparency of government information.
