人权概念与人权话语,不仅在形式上有直接勾连,而且在实质上也存在着复杂的关系。依照语言学人权能指与人权所指这对范畴,揭示出人权概念与人权话语之间的繁复交织的逻辑关联。人权概念向人权话语转换,通过组合型模型和聚合型模型进行互构,前者由人权概念的分解与推演,并进行简单组合构成;后者则有赖于对同种类型、同种性质的人权概念展开进一步的诠释,两者应当被平衡使用。从共时性与历时性的角度来看,人权概念与人权话语的转换机制应考察两者在具体社会中发生的变迁,并从中寻找语境中的历史线索。在中国语境中,人权话语的言说格局表现为官方主导、学界论证的二元主体模式,为了进一步提升人权话语权,重构一种相辅相成、互动平衡的人权概念与人权话语的关联机制成为必要。
