《民法典》与高水平社会主义市场经济

China's Civil Code and High-level Socialist Market Economy

中国的经济体制改革已经进到“构建更加系统完备、更加成熟定型的高水平社会主义市场经济体制”阶段,《民法典》通过设立财产权属与利用、市场准入、市场交易规则等为发展高水平社会主义市场经济提供基本法。从经济与法律的视角归纳现代市场经济与法治的一般理论,民事单行法立法模式下中国经济运行存在的主要问题,反映了中国在朝向高水平社会主义市场经济体制进程中对成体系的《民法典》的需求。《民法典》体系性特征为高水平社会主义市场经济体制提供了法律基础。

China's economic system reform has entered the stage of“building a systematically better-perfected and more mature high-level socialist market economic system”.China's Civil Code provides the basic law for the development of high-level socialist market economy by means of the establishment of the rules of property ownership and utilization,market access,market transaction,etc.This paper summarizes the general theories of modern market economy and rule of law from the economic and legal perspectives,and raise the institutional demand for Civil Code in China by analyzing the main problems existing in the operation of market economy in China under the legislative mode of separate civil laws.This paper discusses how the systematic characteristics of China's Civil Code provide a legal basis for a high-level socialist market economic system.
