论《民法典·侵权责任编》的立法价值

On the Legislative Value of Tore Liability of the Civil Code

《民法典》的颁布标志着我国民法体系完成了从“法律”到“法典”的转换。《民法典》在我国民事单行法律的基础上编纂而成,有着扎实的立法基础。《民法典·侵权责任编》更是在《侵权责任法》等侵权责任法律法规的基础上与时俱进,不断创新发展。侵权责任法的立法价值是寻求保护被侵权人权益和维护个人行为自由间的平衡,在正面评价《民法典·侵权责任编》立法价值的同时,也应看到其不足之处,即责任法定原则不够明确、间接被侵权人的精神损害赔偿范围有待商榷、生态环境侵权责任相关制度应予完善等。这些问题在今后的法律修订或司法解释中应予以完善。

The promulgation of civil code marks the completion of the transformation from“law”to“code”in China's civil law system.The civil code is compiled on the basis of separate laws of civil law in China,which has a solid legislative foundation.On the basis of tort liability law and other tort liability laws and regulations,tort liability series keeps pace with the times and constantly innovates and develops.This paper points out that the legislative value of tort liability law is to seek the balance between the protection of the rights and interests of the infringed and the protection of individual freedom of conduct.While positively evaluating the legislative value of the civil code of tort liability,the deficiencies of the civil code of tort liability are pointed out dialectically:the principle of liability is not clear enough,the scope of compensation for mental damage of indirect infringed is open to discussion,and ecology.The relevant system of environmental tort liability should be improved,and the corresponding suggestions are put forward.
