功能与维度:法治的中国话语体系的建构策略

Function and dimension: the construction strategy of Chinese utterance discourse system of rule of law

随着中国法治建设的不断深入推进,形成完整、有效陈述、评价、归纳和阐发并进行意向表达和传递的符号体系,即法治的话语体系成为法治建设的内在需求。法治的话语体系的本质是主体间性交互过程,基本功能是对法治行动实践和法学研究实践的信息和意向进行归纳与传递,对广泛的社会主体产生影响力,改变社会意识结构。当前关于法治的话语体系以移植自国外法律体系的概念、理论和叙事为主体,与中国法治实践不具有共同的社会结构基础,无法准确阐述和表达不断发展的法治实践的意向。遵循本土法治实践的建构策略,以法治话语体系的功能实现机制为核心,从申扬中国社会的主流价值观、坚持以法哲学基本概念和理论为内涵、在中国社会历史的特定时空背景中拓宽法治话语元素的外延等三个维度出发,建构法治的中国话语体系,为中国法治建设奠定广泛而坚实的社会共识基础。

With the continuous development ofthe construction of rule of law inChina,forminga complete and effectivethe symbol discourse system of the rule of lawthatincluding statement,evaluation,induction and elucidation,as well asexpression and transmission of the intention,has become the internal demand of the construction of the rule of law.The essence of the discourse system of rule of law isthe process ofinter-subjectivity,andthatbasic function is to summarize and transmit the information and intention of the practice of legal action and law research,so as to exert influence on a wide range of social subjects and change the structure of social consciousness.But the current discourse system is dominated byconcepts,theories and narratives from foreign legal system,which do not share the same social structure as the practice of the rule of law in China,and cannot accurately elaborate and express the intention of practice of the rule of law,which is developing constantly.Therefore,the construction of the Chinese discourse system of the rule of lawwhich building broad and solid foundation of social consensus ought tofollowthe construction strategy of local practice of rule of law,take the function realization mechanism of legal discourse system as the core,startfrom three dimensions like developing the mainstream values of Chinese Society,insisting the basic concept and theory of law philosophy for the connotation,and broadening the extension of legal discourse elements in specific Chinese social and historical background of time and space.
