摘要
本文通过对2017年3月至2020年4月中国裁判文书网上公布的争议观点为二倍工资的各省(自治区、直辖市)高级人民法院再审判例进行实证研究,从工资的含义、立法目的、司法实践三个维度进行论述,认为未签订书面劳动合同的二倍工资差额应是对用人单位的一种惩罚,与劳动者所取得的劳动报酬有着本质区别。
Through the empirical study on retrial cases of national higher peoples court concerning controversial views on double wages from January,2017 to April,2020 the thesis from the meaning of wages,legislative purposes,judicial practice three dimensions,makes a discussion that regulation on double wages balance is the punishment for employer who don t sign written labor contract and also makes sessential differences between labor remunerations from employees.
