中国法的对外翻译——以欧盟法的翻译策略、实践及经验为镜鉴

Translation of Chinese Law:A Reference to the EU Legal Translation

法律外译是中国法在全球法律多元格局下构建自我表达的重要方式。"一带一路"倡议的展开,要求中国法以更开放的姿态,对外传递中国法话语。中国法的外译不是简单的语言转换,而是同普通法、大陆法、伊斯兰法中主要法律话语的交流。中国法应以独立而合作的姿态表达新话语,为全球法治建设贡献中国智慧。通过分析对比,本文发现,欧盟机构多年来寻求构建独立的欧盟法话语,这一重任首先在法律翻译上。其兼采同化和外化翻译策略,为欧盟法的独立构建和认同提供坚实支撑。中国法的外译可借鉴这一经验,以基于语境为导向的翻译策略,表达中国特色法律话语。

Legal translation plays a significant role for Chinese law to form self-expression under the global legal pluralism.The launch of the "Belt and Road" Initiative requires discourse of Chinese law to be understood in a more efficient way.The translation of Chinese law is not merely a simple language exchange,but a communication with the common law,civil law and Islamic law,hence Chinese law should express new concepts in an independent and cooperative manner,so as to contribute to the development of global rule of law with Chinese wisdom.Based on analyses and comparisons,this paper finds that legal translation plays an essential role in the construction of a new discourse of EU law that EU institutions have been seeking to.Both familiarization and externalization translation strategies were adopted to solidly support the construction and recognition of EU law.The translation of Chinese law can learn from such experience,combined with context-oriented translation strategy,to express discourse of law with Chinese characteristics.
