Judicial Deviation and Correction of Basic Principles in Criminal Law

刑法中的基本原则通过实践过程不断得到完善,司法机关的执法活动在其中发挥着至关重要的作用。从客观角度来讲,实务界在刑法基本原则贯彻落实方面并未取得良好的成果,在一些现实问题和案件的解决和处理方面,太过现实和功利,也就是专家学者指出的实用主义和功利主义,导致司法实践活动无法彻底落实刑法基本原则。本文根据上述问题,针对司法实践活动中刑法基本原则的贯彻落实措施,给出几点意见以供参考。

the basic principles of criminal law are constantly improved through the practice process,and the law enforcement activities of judicial organs play an important role in it.From an objective point of view,the practical circle has not achieved good results in the implementation of the basic principles of criminal law.In the settlement and handling of some practical problems and cases,it is too realistic and utilitarian,that is,the pragmatism and utilitarianism pointed out by experts and scholars,leading to the judicial practice activities can not fully implement the basic principles of criminal law.According to the above problems,this paper gives some suggestions for the implementation of the basic principles of criminal law in judicial practice.
