航空产业人工智能发展的知识产权制度促进体系研究

摘要 航空产业人工智能的发展对国家具有重要的战略意义,因而需要系统的知识产权制度支持。航空产业人工智能的研发需要委托、合作开发合同制度、职务发明制度和大数据政策等的激励。航空产业人工智能的应用需要借助技术标准法律制度、科技成果转化政策、地方科技产业政策、军民融合和一带一路倡议措施等来破除其在多方面的封闭性。航空产业人工智能的法律保护需要合理地解释“可专利性”标准,细化商业秘密保护的条件,以及更为科学地进行知识产权的行政保护和司法保护。航空产业人工智能的风险规制则需要严格进行人工智能专利申请的合法性和安全性审查,强调专利技术“充分披露”的法律要求,落实知识产权人在转让或许可中的技术安全指导义务,以及建立全供应链的合理责任分配制度。 The development of artificial intelligence in the aviation industry has important strategic significance for the country and therefore requires systemic intellectual property system support.The research and development of the aviation industry's artificial intelligence needs incentives such as contract systems of commissioned,cooperative development,service invention systems,and big data policies.The application of artificial intelligence in the aviation industry requires the use of technical standards legal systems,policies for the transformation of scientific and technological achievements,local industrial policies for science and technology,military and civilian integration,and the Belt and Road Initiative strategic measures to eliminate its closure in many aspects.The legal protection of the artificial intelligence in aviation industry needs to rationally explain the"patentability"standard,refine the conditions for the protection of trade secrets,and conduct scientific protection and judicial protection of intellectual property more scientifically.The risk regulation of aviation industry artificial intelligence needs to strictly examine the legality and safety of patent applications for artificial intelligence,emphasize the legal requirements for"full disclosure"of patented technologies,implement the technical safety guidance obligations of intellectual property owners in transfer or licensing,and establish a reasonable liability distribution system for the entire supply chain.
