《中國法律》:《兩地保全安排》自去年生效以來受到業界廣泛關注,請問HKIAC目前實踐情況如何?袁國強:如你所知,根據去年10月1日生效的《關於内地與香港特別行政區法院就仲裁程序相互協助保全的安排》(下稱「《安排》」),仲裁地為香港且由HKIAC管理的機構仲裁案件當事人可向内地人民法院申請仲裁保全,包括財產保全、行為保全和證據保全。

China Law:The Hong Kong-China's Mainland Arrangement on Interim Measures has received wide attention from the law field since it went into effect last year;what is the current practice of HKIAC?Rimsky Yuen:As you know,according to the Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the Hong Kong Special Administrative Region(hereinafter referred to as"the Arrangement"),a party to arbitral proceedings occurred in Hong Kong and arbitrated by an institution managed by HKIAC may make an application for interim measures,including property preservation,evidence preservation and conduct preservation,to people's courts of mainland.
