法律行为违反强制性规范若干理论误区的辨析

Analysis of Some Theoretical Misunderstandings of Legal Act Violating Mandatory Norms

效力性规范与管理性规范的区分意义,仅局限于理念上的启发,并不能作为违反强制性规范的法律行为效力的判断标准。寄希望于通过所谓“原则无效、例外有效”的认定方法来判断违反强制性规范的法律行为效力,并不能真正解决问题。把违法与背俗作一元化的处理,以是否违背社会公共利益作为违反强制性规范的法律行为效力的判断标准,也是站不住脚的。

This paper argues that the gap between effective norms and administrative norms shall not be adopted as the criterion to judge the validity of legal act violating mandatory norms as it is only a kind of intuition lack of rationality.And the paper considers it no resolution to judge the validity of legal act violating the mandatory norms by the so-called invalidity in principal while validity is exception.Moreover,the paper claims it impractical to either confuse the violation of law with the violation of ethnics,or judge the validity of legal act violating mandatory norms by such principle as whether it violates the social and public interests.
