人工智能时代读者个人信息保护模式的选择

Selection of a Mode for Reader’s Personal Information Protection in the Era of Artificial Intelligence

随着智慧图书馆不断发展,公共图书馆中的读者个人信息保护面临着更大的风险。通过梳理、反思个人信息权模式与隐私权模式的确立过程,认为这两种模式均无法有效保护读者个人信息。人工智能时代读者个人信息的保护,重点在于规范义务人的行为,规避个人信息收集、利用过程中的风险,故应采用行为规范模式。因此,文章在明确行为规范模式的法理基础及比较优势的基础之上,结合现有法律规范,重点论述、明确了读者个人信息收集、利用以及保有阶段的具体行为规范,由此完成了对行为规范模式合理性与可行性的论证。

With the continuous development of smart library,the protection of readers’ personal information in public libraries is facing a greater threat.By sorting out and reflecting on the establishment process of the mode of personal information right and the mode of privacy,this paper holds that both modes cannot effectively protect readers’ personal information.In the era of artificial intelligence,the protection of readers’ personal information focuses on regulating the behavior of obligors and avoiding the possible risks in the process of collection and utilization of personal information.Therefore,on the basis of clarifying the jurisprudential basis and comparative advantages of the mode of behavior regulation,combined with the existing legal norms,this paper focuses on discussing and clarifying the specific code of conduct of readers’ personal information collection,utilization and retention,completing the demonstration of the feasibility and rationality of the behavior regulation mode.
