论“刑法学”教学中的三个问题

On the Three Problems in Criminal Law Teaching

当下的"刑法学"教学应当着重解决以下三方面的问题:一是正确刑法理念的灌输,要通过刑法基本原则的讲解,说明刑法存在的价值在于限制国家刑罚权恣意发动,在刑法的适用上要平衡人权保障和犯罪打击双重功能;二是采取比较的方法讲解犯罪构成理论,充分运用大陆法系的犯罪论体系的内容训练学生的法律思维;三是灵活运用案例教学方法,因为刑法理念的灌输、犯罪论知识的掌握,都需要恰当的刑法案例加以诠释。刑法案例教学需要与研究型教学以及准判例恰当结合起来,提高学生法律适用能力、法律理论素养和对社会现实关注的人文情怀。

At present,the teaching of criminal law should focus on solving the following three problems:first,the inculcation of correct criminal law concept,through the explanation of the basic principles of criminal Law,the existence value of criminal Law lies in the restriction of the state penalty power to launch arbitrary,the application of criminal Law to balance the dual function of human rights protection and criminal activity.Second,to take the comparative method to explain the theory of crime constitution and make full use of the content of the theory of crime of the civil law system to train students’legal thinking.Third,the flexible use of case teaching method,because the installation of criminal law concept,and criminal theory knowledge grasp,need to be interpreted by the appropriate criminal case.The case teaching of criminal Law should be combined with research-based teaching and quasi-cases to improve students’legal application ability,legal theory literacy and humanistic feelings to social reality.
