从“小i机器人”的无效案看权利要求的清楚性问题

权利要求书是专利申请文件和专利文件的重要组成部分,其表达方式不仅影响授权阶段专利申请能否被授予专利权以及确权阶段能否被维持专利权有效,而且还影响侵权诉讼阶段对专利权的保护范围的界定。本文借助“小i机器人”无效案旨在阐明在撰写过程中应该正确认识权利要求的清楚性问题,这对于在刻画出申请特征点的同时避免写入限制性特征或非必要特征等方面具有重要意义。

Claims are important parts of patent application documents and patent documents,and ways of expressions thereof have effect on not only whether an application for patent may be granted a patent in a grant phase and whether a patent may be maintained valid in aright confirmation phase,but also on defining a protection scope of a patent right inaninfringe lawsuit phase.In virtue of the case of invalidation of iRobot,this article discusses that the issue of clarity should be correctly acquainted during drafting of application documents,which is of great significance to avoidance of incorporating restrictive features or unnecessary features in drafting while describing feature points of the application.
