On Legal and Ethical Attributes of Doctor-Patient Relationship

我国医疗体系存在医患关系问题,而伦理属性对解决问题有特殊作用。法律属性包括法律属性学说论争、法律属性定位;伦理属性包括道德关系层面和医患关系泛法律化危害层面。处理好医患关系是目前医院体系运行和发展的重点工作内容,只有将医法和医德结合起来进行研究,才能逐步达成构建和谐医患关系的目标。

There exists a problem of doctor-patient relationship in China’s medical system,and ethical attributes play a special role in solving the problem.Legal attributes include theoretical debate and attribute positioning;while ethical attributes involve the level of moral relation as well as the hazardous level from general legalization of doctor-patient relation.Dealing with the doctor-patient relationship is the key content for the operation and development of the hospital system at present.Only by combining medical law and medical ethics can we gradually achieve the goal of building a harmonious doctor-patient relationship.
