基于治理效能提升的我国社会工作法律体系构建

The Construction of Legislation System of Social Work Based on the Improvement of Governance Efficiency

在完善的、有效的社会治理体系中,社会工作的法治保障尚未充分实现。我国社会工作法律体系建设,需以中国特色社会主义社会治理思想为指导,以社会工作职业化建设为目标,以学术研究成果为基础。我国的社会工作立法,在服务受体方面相对成熟,主体方面、机构与组织方面的立法有所欠缺,地域差异明显,且尚无针对社会工作者和社会工作组织的专项立法。我国的社会工作法律体系建设,以建立与完善中国特色社会工作法律体系为目标,以规范社工机构和政府购买服务为重点,以提高立法层级和法律效力为原则,以完善社会工作者与社会工作对象的权利义务关系为内容,以加强法律法规的可操作性为关键,以完善不同社会工作领域和地方行业规章制度为基础。

In a sound and effective social governance system,the rule of law in social work has not yet been fully realized.The construction of the legislation system of social work in China should be guided by the thought of social governance with Chinese characteristics,take the professionalization of social work as the goal,and take the achievements of academic research the basis.China’s social work legislation is relatively mature in terms of service recipients,while lacking in legislation in terms of subjects,institutions and organizations,and showing obvious regional differences.Up to now,there is no special legislation for social workers and social work organizations.Therefore,in order to construct the legislation system of social work in our country,we need to take the establishment and improvement of the legal system of social work with Chinese characteristics as the goal,take the standardization of social work institutions and government purchase services as the key point,take the improvement of legislative level and legal effect as the principle,take the improvement of the rights and obligations relationship between social workers and social work objects as the content,take strengthening the operability of legal law and regulations as the key,and take improving the rules and regulations in different social work fields and local industries as the basis.
