新冠肺炎疫情防控期间公安机关执法规范化提升研究

Study of the Police Law Enforcement Standardization in thePeriod of COVID-19 Epidemic Control

公安机关在新冠肺炎疫情防控中发挥了重要作用,但在执法过程中也反映出一些问题,如法律保留原则的适用问题、执法行为的合法性问题,自由裁量权的运用问题,公民权利受损后的救济途径问题等,主要原因在于特殊状态下公安执法的规则供给不足。提升公安机关执法规范化,应当从宏观和微观的维度进行优化完善:宏观上,提升执法理念,明确执法过程中应当遵循的基本原则;微观上,完善重大传染病疫情期间公安执法的规范性文件,提升执法人员理论水平,加强疫情知识宣传,明确公民在疫情防控期间的相关行为应承担的法律责任。

Public security agency plays an important role in the Covid-19 epidemic control.However,some problems emerge from the typical cases that actually happened.For example,the principle of legal reservation is violated and the legality of law enforcement is challenged;the police's discretion is abused;the arbitrary law enforcement disrupts the legal procedure;the relief and rescue are unavailable to civilians,etc.The reason for that is the inefficiency of law enforcement instructions and it should be corrected and optimized from both macroscopic and microscopic dimensions.At the macroscopic level,the concept of law enforcement should be enhanced,and basic principles should be strictly followed in theprocess of law enforcement.At the microscopic level,the normative documents for police law enforcement during major infectious epidemic should be completed;the theoretical capability of law enforcement officers should be enhanced;the publicity of the disease control should be strengthened;the legal responsibilities of the civilians during the epidemic should be notified.
