法律是在特定的社会文化背景下形成的,具有鲜明的民族特性与文化特质。法律翻译实质是一种跨文化交际,必然受到特定社会文化的规约。译者要正视文化差异造成的客观翻译困难,采用各种翻译策略进行文化补缺,设法做到源语与目的语的功能对等,尽力达到既准确传递源语法律内涵又尽可能符合目的语法律文化的理想翻译。

Law is formed under a specific social and cultural background,with distinct national and cultural characteristics.The essence of legal translation is a kind of intercultural communication,which is bound to be stipulated by specific social culture.Translators should face up to the objective translation difficulties caused by cultural differences,adopt various translation strategies to fill the cultural gaps,try to achieve functional equivalence between the source language and the target language,and achieve rational translation that accurately conveys the legal connotation of the source language and at the same time conforms to the legal culture of the target language as much as possible.
