基层治理视域下人民调解制度的完善

完善和发展人民调解制度必须明确其定位。人民调解兼具纠纷解决与基层治理的双重功能,具有自治性、主动性、便捷性、准司法性的基本属性。从基层治理的角度看,人民调解具有提高人民法律观念、促进德治法治结合、实现基层群众自治、提高纠纷解决效率的作用。新时代完善人民调解制度,需要坚持人民调解制度的自治性、健全调解队伍建设发展体系、建立矛盾隐患事前化解机制、加快其他社会调解制度立法。

To improve and develop the people's mediation system,its position must be clearly defined.People's mediation system has the dual functions of dispute resolution and local governance.It has the basic attributes of autonomy,initiative,convenience,and quasi-judicial nature.From the perspective of local governance,people's mediation system has the functions of improving people's legal concepts,promoting the combination of the rule of virtue and the rule of law,realizing local democratic autonomy,and improving the efficiency of dispute resolution.To improve the people's mediation system in the new era,it is necessary to uphold the autonomy of the people's mediation system,to improve the building and development system of mediation team,to establish a mechanism for resolving potential conflicts in advance,and to accelerate the legislation of other social mediation systems.
