整体性治理视角下综合行政执法改革的深化之道

The Deepening Path of Comprehensive Administrative Law Enforcement Reform from the Perspective of Holistic Governance

党的十九届四中全会将深化综合行政执法改革摆在了新时代治国理政布局中更加突出的位置,成为推进国家治理体系和治理能力现代化需要高度关注的一项研究议题。"深化"是"中国之治"重大命题之下综合行政执法改革的核心要义,当前我国综合行政执法改革在取得一定成效的同时,也面临着一系列"碎片化"困境,集中表现在执法主体、执法理念、执法职能、执法资源、执法流程和执法责任上,整体性治理则为综合行政执法改革向纵深推进提供了一个观察视角。基于深化综合行政执法改革的整体性治理框架,运用整体性治理理念中协调、整合和信任的有益思路,构建我国综合行政执法改革从"碎片化"到"整体性"的深化路径。这一深化研究修正了对综合行政执法改革的发展判断,为进一步增强改革的系统性、整体性和协同性指明了方向。

The Fourth Plenary Session of the 19 th Central Committee of the Communist Party of China places the deepening of the reform of comprehensive administrative law enforcement in a more prominent position in the governance of the country in the new era,and it has become a research topic that requires great attention in promoting the modernization of the national governance system and governance capabilities."Deepening"is the core of the comprehensive administrative law enforcement reform under the major proposition of"Government of China".While the current comprehensive administrative law enforcement reform in our country has achieved certain results,it is also facing a series of"fragmentation"dilemmas,which are concentrated in the main body of law enforcement.In terms of law enforcement concepts,law enforcement functions,law enforcement resources,law enforcement procedures,and law enforcement responsibilities,overall governance provides an observation perspective for the in-depth advancement of comprehensive administrative law enforcement reform.Based on the holistic governance framework of deepening the comprehensive administrative law enforcement reform,using the beneficial ideas of coordination,integration and trust in the holistic governance concept,construct a deepening path from"fragmentation"to"integrity"of our country’s comprehensive administrative law enforcement reform.This in-depth study revised the development judgment on the reform of comprehensive administrative law enforcement,and pointed out the direction for further enhancing the systemicity,integrity and coordination of the reform.
