论深层地下空间开发的专门化立法

Specialized Legislation of Deep Underground Space Development

近年来,城市土地资源日渐紧张,人们逐渐重视开发利用深层地下空间,但与之对应的法律制度并不完善,深层地下空间开发的立法存在立法层级不高、零散化、缺乏专门性规定及权利内涵不清晰等严重不足,立法的缺陷可能引发新的资源浪费和环境破坏。通过对现行立法的分析,提出了应针对深层地下空间的特点,进行其开发的专门化立法。

In recent years,the contradiction between man and land has become more and more acute,and urban land resources are becoming increasingly tense.People gradually pay attention to the development and utilization of deep underground space,but the corresponding legal system is not perfect.There are serious deficiencies in the legislation of deep underground space development,such as low legislative level,scattered,lack of special provisions and lack of core rights.The defects of legislation may lead to new resources waste and environmental damage.Based on the analysis of the current legislation,this paper puts forward the special legislation for the development of deep underground space according to its characteristics.
