我国不可移动文物认定的法理考量

A Legal Study of the Identification of Immovable Cultural Relics in China

不可移动文物是物质文化遗产的重要组成部分,对其进行认定是后续实施保护和管理的前提和基础。没有认定就没有保护。在现有立法对不可移动文物采取分类列举的基础上来看,目前实践中存在着不可移动文物认定标准不明确,认定程序不完善,以及认定与登记、登录等环节衔接不畅,认定部门与其他部门缺少联动等诸问题。为此,应明确不可移动文物的认定标准,完善认定程序,实现信息共享,健全登录制度。

Immovable cultural relics are critical components of material&cultural relics,and the identification of immovable cultural relics is a premise and foundation for their protection and management.Without identification,there is no protection.On the basis of classifying the immovable cultural relics in the existing legislation,there are many problems in the current practice,such as unclear identification standards,inefficient identification procedures,poor connection between identification,registration,filing as well as a lack of linkage between the identification department and other departments.Thus,in the future,it is necessary to clarify the identification standards of immovable cultural relics,improve the identification procedures,realize information sharing,and improve the register system.
