我国反腐败境外追赃面临的挑战及应对思路

按照刑法规定、通过境外民事诉讼、根据刑事司法协助条约或国际条约、运用刑事政策督促腐败分子或其亲属主动退赃,是我国反腐败境外追赃的主要方式。做好该项工作有利于产生威慑作用,督促腐败分子投案自首,也有利于更好地对腐败分子定罪量刑,实现刑法预防犯罪的目的,维护国家利益和世界经济秩序的和谐稳定,但目前在法律规定、国际刑事司法合作、专业人才建设、情报信息交流等方面依然面临挑战。有必要健全国内法律法规,为境外追赃提供充分的法律依据;深化国际刑事司法合作,建立合理的资产分享机制;重视专业人才建设,打造高素质的境外追赃执法队伍;加强“互联网+”时代的情报信息交流,提高境外追赃实效。

In accordance with the provisions of the criminal law, through overseas civil litigation, in accordance with criminal judicial assistance treaties or international treaties, the use of criminal policies to urge corrupt elements or their relatives to voluntarily return stolen goods are the main methods of my country’s anti-corruption efforts to recover stolen goods abroad. Doing a good job of this work is conducive to deterrence, urges corrupt elements to surrender, and is conducive to better conviction and sentencing of corrupt elements, better realize the purpose of criminal law to prevent crime, and better maintain the harmony and stability of national interests and the world economic order. However, there are still challenges in terms of legal regulations,international criminal justice cooperation, professional talent building, and intelligence and information exchange. It is necessary to improve domestic laws and regulations to provide sufficient legal basis for overseas recovery of stolen goods;deepen international criminal justice cooperation and establish a reasonable asset sharing mechanism;attach importance to the construction of professional talents to create high-quality overseas stolen stolen law enforcement teams;and strengthen the "Internet +" era The exchange of information and information to improve the effectiveness of overseas recovery of stolen goods.
