高校法律援助组织参与诉讼行为研究——基于144份裁判文书

高校法律援助组织具有公益性、超出预期的专业性和更强的广泛性的特点,既满足了法学教育对法律实践的需求,也对政府主导型的法律援助体系进行了很好的补充。但通过对检索案例的分析发现,在提供诉讼法律服务的过程中,高校法律援助组织仍面临着案源不足、发展不均衡、援助范围不明确等问题。为解决这些问题,首先需要先厘正高校法律援助组织在法律援助体系及法科教学中的定位,确认其作为补充性援助主体的地位,保障组织在法律援助及法科教学预期的轨道上运行,进而以此为基础,通过划定援助范围、优化分案机制、加强校际合作等方式,推动高校法律援助组织的诉讼法律服务向着更深层次发展。

Legal aid organizations in colleges and universities have the characteristics of public welfare,professional beyond expectations and stronger universality,which not only meet the needs of legal practice in legal education,but also supplement the government-oriented legal aid system.But through the analysis of the retrieval cases,in the process of providing litigation legal services,the university legal aid organizations are still faced with the problems of insufficient case sources,uneven development,unclear scope of assistance and so on.To solve these problems,first of all need to improve the legal aid organization in the legal aid system and the method of science learning orientation,confirmed it as a supplementary aid main body status,security organizations in legal aid and law science study expected orbit and then on this basis,through the defined scope of aid,optimize the division mechanism,strengthen intercollegiate cooperation way,promote the legal aid organization of legal service towards deeper development.
