摘要
我国农村宅基地使用权的流转是根据我国农村土地产权相关制度规定的变化经历了由宽松到严格再到适度放开的不同阶段。当前,村民对于宅基地享有的只是使用权。不过,在农村现代化背景下,在农村宅基地“三权分置”的提出为实现农村宅基地上市流转提供理论支撑的背景下,通过对行政审批制度下可能存在的弊端进行分析,总结出问题所在,提出具体的解决措施,从而让农村宅基地能够上市流转的同时,也能够更好的保护集体经济组织和村民的相关权益。因此,对农村宅基地的流转进行相关研究就显得尤为必要。
The circulation of the right to use rural homesteadland in China has experienced different stages from leniency to strictand then to moderate liberalization according to the changes of the relevant system provisions of rural land property rights in China.At present,the villagers only enjoy the right to use the homestead.However,under the background of rural moderniza⁃tion in the rural homestead"separation division"is put forward for the realization of the rural homestead listed circulation to provide theoretical support,under the background of the administrative examination and approval system of possible defects were analyzed,and summarizes the problem,put forward concrete solving measures,so that the rural housing land can be trad⁃ed at the same time,also can better protect the relevant rights and interests of collective economic organizations and the villag⁃ers.Therefore,it is particularly necessary to study the transfer of rural homestead.
