基于虚实空间交互的网络犯罪侦查新模式及其意义

A New Model and Significance of Cybercrime Investigation Based on the Interaction of Virtual and Real Space

近年来,网络犯罪呈高发态势,其犯罪形态也逐年变化,采用传统的“人—事(或案)”侦查模式,及衍生的“事—机—人”侦查模式都难以应对取证难、定罪难、漏罪多及办案成本高等难题.透过网络犯罪行为,分析人与网络空间交互方式以及网络空间和现实世界交互的规律,提出“人—媒介物—虚拟人”网络侦查新模式,从侦查思考路径、取证固证方向、情报分析要点等方面分析了新模式的可行性.此外,新模式将在电子数据取证、发现隐案积案、人工智能学习及网络案件网络办等方面发挥积极作用.

In recent years,cybercrime has been on a high-incidence trend,and its crime patterns have also changed year by year.The traditional“person-event(or case)”investigation model and the derivative“event-machine-person”investigation model are difficult to deal with the difficulties of obtaining evidence,difficult conviction,frequent omissions,and high case handling costs.Through analyzing the interaction between people and cyberspace and setting up the law of interaction between cyberspace and the real world,we propose a new model for investigation,which is“human-media-virtual person”model.In addition,the new model will have positive effects in fields of identifying cybercrime,including collecting digital evidence,revealing the hidden cases,analyzing the criminal cases by artificial intelligence and managing cases online.
