摘要
解雇保护制度不仅关系着劳动者的生存发展,也会影响社会劳动关系的稳定,不当解雇法律救济制度作为其重要组成部分,彰显着一国对劳动者的保护程度。我国劳动立法虽然坚持社会法本位对不当解雇进行救济,但仍有不足之处。应健全劳动行政部门监督处理机制、灵活适用不当解雇司法救济方式、细化不当解雇赔偿金计算方法、明确劳动合同不能继续履行标准,从而更好地保障劳动者的合法权益和用人单位经营自主权的有效实行。
Dismissal protection system is not only related to the survival and development of workers,but also affects the stability of social labor relations.As an important part of the legal relief system of improper dismissal,it shows the degree of protection of workers in a country.Although China's labor legislation adheres to the social law standard to relieve improper dismissal,there are still some deficiencies.We should improve the supervision and handling mechanism of labor administrative departments,flexibly apply judicial relief methods for improper dismissal,refine the calculation method of compensation for improper dismissal,and clarify the standards for the continuous performance of labor contracts,so as to better protect the legitimate rights and interests of workers and the effective implementation of the employer's autonomy.
