摘要
在海洋强国战略和一带一路倡议背景下,我国外派船员的数量也在不断增加。相应地,船员外派也带来了很多问题,对我国现有的《海商法》《劳动法》《劳动合同法》《船员条例》等法律法规建立起来的体系构成挑战。其中,外派船员能否将船舶优先权转移给船员外派机构成为实务中常见的问题。船员外派存在诸多不同的模式,产生了不同的三方关系。在不同的船员外派模式下,船舶优先权的转让与代位问题也有不同的解决途径。
Under the background of“The Marine country strategy”and“The Belt and Road Initiative”,the number of dispatched crews abroad is increasing.Accordingly,there are many problems brought about by the crew dispatch,which challenges the system established by the maritime law,the labor law,the labor contract law,the crew regulations and other laws and regulations.Among them,whether the dispatched crew can transfer the maritime lien to the crew manning agency has become a common problem in practice.There are many different modes of crew dispatch,resulting in different tripartite relations.In different modes of crew dispatch,the problem of assignment and subrogation of maritime lien have different solutions.
