论政府信息公开中的过程性信息认定规则

On the Rules of Identifying Procedural Information in Government Information Disclosure

我国政府信息公开制度自建立以来,豁免的信息就一直存在争议,其中的过程性信息由于标准未定一直是信息诉讼争议中的焦点。2019年,我国《政府信息公开条例》将过程性信息规定为相对豁免公开的信息,但是对于其认定问题并未做出规定,进而导致实践中的争议愈加频繁。基于这一现实情况,严格对过程性信息进行认定成为当前的首要任务。因而,分析信息背后逻辑,利用行政程序与信息状态分析相关判决,进而通过法律解释认定过程性信息是当今法律实务中的关键点。

Since the establishment of China’s government information disclosure system,the exempted information has been controversial,and the procedural information has always been the focus of information litigation disputes because of the undetermined standard.In 2019,China’s legal system stipulated the procedural information as the relatively exempted information,but there was no provision for its identification,which led to more frequent disputes in practice.Based on this reality,strict identification of procedural information has become the primary task at present.Therefore,analyzing the logic behind information,using administrative procedures and information status to analyze relevant judgments,and then identifying procedural information through legal interpretation has become the key points in today’s practice.
