智慧法院背景下类案同判问题研究

A Study of the Same Judgment of Similar Cases under theBackground of Smart Court

智慧法院建设为统一法律适用提供了新的契机。2020年7月,最高人民法院印发了《关于统一法律适用加强类案检索的指导意见(试行)》。在此基础上,在机制上明确上级法院的已决裁判对下级法院判决同类案件有约束力,同一法院的已决裁判对其以后判决同类案件具有约束力;在技术上,搭建大数据案例平台,提高现有的技术水平。

The construction of smart court provides a new opportunity for unifying the application of law.In July 2020,the Supreme People’s Court issued the Guiding Opinions on Uniform Law Application to Enhance Case Retrieval(Trial).On this basis,in the mechanism,it is clear that the judgment of the higher court is binding on the judgment of the lower court in similar cases,and the judgment of the same court is binding on the later judgment of similar cases;in the technology,it is necessary to build a big data case platform to improve the existing technology level.
