超大型数字平台企业双轮垄断的规制范式

The Regulatory Paradigm of Double Round Monopoly of Super-large Digital Economy Platform Enterprises

超大型数字平台企业不仅可以通过实施双轮垄断的路径构筑数字化生态系统,而且能够利用其对平台、渠道与数据的控制而获得统合型市场支配力。在超大型数字平台企业双轮垄断行为规制层面,渊源于工业经济时代的反垄断法律制度暴露出滞后性、僵化性、非全面性的弊端。鉴于这一情形,我国立法机关应当针对《反垄断法》实施数字化革新,通过增设新型禁止滥用市场力条款方式实现规制补强与补位目标,并重构垄断纠纷民事诉讼举证责任分配机制,最终构建包括反垄断监管与数据安全监管在内的“多位一体”的统合型规制机制。市场监管机关亦应当针对超大型数字平台企业双轮垄断行为采用全景式、前置式与穿透式反垄断监管方式,并确保超大型数字平台企业施行的大数据资源搜集、整合、分析、利用行为契合社会公共利益需求。

Super-large digital economy platform enterprises can build a digital ecosystem by implementing a double round monopoly on the one hand,and on the other hand,they can use their control of platforms,channels and data to gain integrated market power.At the level of regulation of the double round monopoly behavior of super-large digital economy platform enterprises,the anti-monopoly legal system that emerged in the industrial economy era has exposed the drawbacks of hysteresis,rigidity,and incompleteness.In view of this situation,Chinese legislature should implement digital innovations in the Anti-Monopoly Law and achieve the goals of strengthening regulation and expanding the scope of regulation by adding new prohibition of abuse of market power clauses,and reconstruct the distribution mechanism of the burden of proof in civil litigation of monopolistic behavior,and then a multi-in-one integrated supervision mechanism including anti-monopoly supervision and data security supervision will finally be shaped.The law enforcement agencies should also implement a panoramic,front-end and penetrating anti-monopoly supervision method against the double round monopoly of super-large digital economy platform enterprises,and ensure that big data resource collection,integration,analysis,and utilization behavior of super-large digital economy platform enterprises conforms to the needs of social public interest.
