我国食用菌地理标志法律保护思考

Legal Protection of Geographical Indications of Edible Fungi in China

对我国地理标志产品的发展现状进行了分析,并结合食用菌的产业规模、地理标志产品的保护制度的内容以及特点等,对国内食用菌地理标志产品受法律保护的现状进行了介绍。在对地理标志产品进行保护的过程中,基本上存在着政府部门的监察力度较弱,相关工作开展过程不规范以及保护制度不够完善等。为此当地政府需要加强地理标志保护意识,并及时制定有效的监管制度。同时,还需要在建立起有效的技术规范标准基础上,增强厂家以及消费者的标志使用意识。

This paper analyzes the development status of China’s geographical indication products, and combined with the scale of edible fungi industry, the content and characteristics of the protection system of geographical indication products, etc., to introduce the legal protection status of domestic edible fungi geographical indication products. In the process of protecting geographical indication products, there are basically the following problems: the supervision of government departments is weak, the process of relevant work is not standardized and the protection system is not perfect. Therefore, local governments need to strengthen the awareness of geographical indication protection and formulate effective supervision system in a timely manner. At the same time, on the basis of establishing effective technical specifications and standards, it is also necessary to enhance the awareness of manufacturers and consumers in the use of the logo.
