紧急状态视域下处理突发公共卫生事件的策略分析

Handling Strategies for Public Health Events from the Perspective of Emergency

紧急状态是现代民主宪政的一个重要课题,也是世界多个国家、地区处理突发公共卫生事件时的主要应急措施。新冠肺炎疫情不仅让紧急状态为公众所熟知,而且全面激活了公众对突发公共卫生事件疫情防控措施的相关思考。文章针对突发公共卫生事件防控工作提出了完善应急法治体系、健全上下一体左右联动的应急管理指挥协调机构、创新完善公共卫生及时报告制度、利用信息化系统做好公共卫生疫情防控的预防预警工作、建立反应迅速高效运行的应急处置体系、依法严厉打击涉疫情刑事犯罪等相关措施,以期为将来处理突发公共卫生事件提供思路借鉴和方法指引。

State of emergency is an important subject of modern democratic constitutionalism,and it is also the most important emergency measure to deal with public health emergencies in the second half of the 20th century.The epidemic situation of NCP not only makes the emergency known to the public,but also activates the public’s thinking on the prevention and control measures of public health emergencies.This paper puts forward some measures to improve the system of emergency rule of law in order to provide reference and method for dealing with public health emergencies in the future.
