Legislative Exploration on the Promotion and Guarantee of Local Ecological Civilization Construction

新时代地方生态文明发展需要以法制为基础,依法促进与保障地方生态文明建设。当前中国已有五个地方出台了生态文明建设促进与保障的地方性法规。以青海和东莞两大生态文明先行示范区立法为例,其立法理念、内容、结构、功能、特色的考量以及法律实施前的立法阐释、法律实施中的功能细化、法律实施后的实效检验与立法完善值得借鉴。地方生态文明建设促进与保障立法应确立法规地位的中心性、定位的权威性和结构的全面性,突出强调把生态文明建设放在社会发展的首位,考察立法效能的重要标准应具有可操作性,做好立法前的充分调研,重视立法后的实效考察,积极跟进立法完善。各地方政府可以结合地方实际积极创制省域、市域地方生态文明建设促进与保障法律制度,依法推进地方生态文明建设效能。

The development of local ecological civilization in the new era needs to promote and protect the construction of local ecological civilization on the basis of legal system.At present,there are five places in China where the local ordinance of ecological civilization construction has been promoted and ensured.Take the legislation of the two major ecological civilization demonstration zones of Qinghai and Dongguan as exam⁃ples.Its legislative idea,content,structure,function and characteristics,as well as the legislative interpreta⁃tion before the implementation of the law,the function refinement in the implementation of the law,the effec⁃tiveness test after the implementation of the law and the legislative perfection are worthy of reference.To pro⁃mote and guarantee the construction of local ecological civilization,legislation should establish the centrality,authority and comprehensiveness of the position of laws and regulations,and emphasize the construction of eco⁃logical civilization as the first priority of social development;the important standard to investigate the effective⁃ness of legislation should be operable;do a good job of investigation before legislation;pay attention to the ef⁃fectiveness after legislation;and actively follow up the improvement of legislation.Local governments can ac⁃tively create local ecological civilization construction in provincial and municipal areas to promote and safe⁃guard the legal system and promote the efficiency of local ecological civilization construction in accordance with the law.
