农地流转纠纷多元化解决机制探索

Research on the Multi-solution Mechanism of Farmland Transfer Dispute

导致农地流转纠纷产生的原因是多方面的,有民间法与国家法存在冲突、政策调整引起利益的冲突、法律规定与农村现实相脱节等因素。现有的当事人和解、调解、仲裁和诉讼等纠纷解决方式虽有重要作用,但均存在着不足,需要从立法、司法、法治宣传、道德教育等方面着手,完善事前预防和事后救济组成的多元化解决机制,把农地流转纠纷解决纳入法治化、制度化的轨道。

There are many reasons for the dispute of farmland transfer,such as the conflict between folk law and laws and regulations,the conflict of interests caused by policy,the disconnection between law and the reality of rural area.Reconciliation,mediation,arbitration and litigation play an important role,but they all have their own shortcomings.We should strengthen legislation,judicature,publicity of the rule of law,moral education,improve the multi-solution mechanism to bring the settlement of rural land transfer disputes into the track of legalization and institutionalization.
